Terms of Service

By accessing or using GiftBangers (the "Service"), you confirm that you are at least 13 years of age and agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, please do not access or use the Service. Continued use of the Service following any posted changes to these Terms constitutes your acceptance of those changes.

GiftBangers is an AI-powered platform that generates personalized songs and music videos for special occasions. You provide us with information about the recipient and the occasion; our AI models compose original lyrics and music tailored to your submission.

All output — including audio files, lyric sheets, and video content — is delivered digitally via email and/or a private link. Physical delivery is not offered. Delivery timelines are estimates and may vary based on system load.

Authentication is handled through Firebase Authentication. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify us immediately at support@giftbangers.com if you suspect any unauthorized use of your account. GiftBangers will not be liable for any loss arising from unauthorized access resulting from your failure to safeguard your credentials.

All payments are processed securely by Stripe. By completing a purchase, you authorize GiftBangers to charge your selected payment method for the amount displayed at checkout.

Because every song is created specifically for you using AI, all sales are final once generation has begun. We do not offer refunds for completed deliverables. However, if we fail to deliver your song within 72 hours of payment (excluding circumstances beyond our reasonable control), you are entitled to a full refund upon request. To request a refund under these circumstances, please contact support@giftbangers.com within 14 days of the expected delivery date.

GiftBangers retains all rights, title, and interest in the platform, including its underlying AI models, software, design, and branding. You retain all rights to the personal story, names, and content you submit through the wizard (your "Input").

Upon successful payment and delivery, GiftBangers grants you a non-exclusive, non-transferable license to use, share, and publicly perform the generated song for personal, non-commercial purposes. You may not sublicense, sell, or commercially exploit the generated output without our prior written consent.

You agree not to use the Service to submit or generate content that:

• Violates any applicable law or regulation
• Contains hate speech, discrimination, or content targeting protected groups
• Harasses, threatens, or defames any individual
• Depicts or promotes violence, illegal activity, or exploitation of minors
• Infringes the intellectual property rights of any third party
• Is intended for commercial resale without GiftBangers' written permission

We reserve the right to refuse, remove, or block any submission that violates these prohibitions, and to terminate accounts of repeat offenders without notice or refund.

To the fullest extent permitted by applicable law, GiftBangers and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

Our total cumulative liability to you for any claim arising from or related to the Service will not exceed the greater of (a) the amount you paid to GiftBangers in the twelve months prior to the claim, or (b) EUR 50.

These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the Republic of Poland, without regard to conflict of law principles. If you are a consumer resident in the European Union, you also benefit from mandatory protections afforded by the laws of your country of residence.

Any disputes shall first be attempted to be resolved through good-faith negotiation. Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Warsaw, Poland, unless mandatory consumer protection law in your country requires otherwise.
